Official Rules
The “IgoUgo’s Photo Feud Contest” (the “Contest”) begins on May 15, 2007 at 12:01 am Eastern Time (“ET”), and ends on June 15, 2007 at 11:59 pm ET (the “Contest Period”).
VOID WHERE PROHIBITED BY LAW.
1. ELIGIBILITY: The Contest is a game of skill sponsored by IgoUgo.com, a division of Travelocity.com LP (“Sponsor”) and is open to individuals who are (i) registered as members of IgoUgo.com; (ii) a legal resident of the 48 contiguous United States (excluding Rhode Island) or the District of Columbia; and (iii) twenty-one (21) years of age or older as of May 15, 2007. Contest is not open to employees, officers, directors, representatives and agents of the Sponsor or any of its parent companies, affiliates, subsidiaries, divisions or advertising/promotion agencies nor is the Contest open to persons who are an immediate family member or a member of the same household (whether related or not) to such employees, officers, directors, representatives and agents. The Contest is intended for viewing in the United States only and shall only be construed and evaluated according to United States law. You are not authorized to participate in the Contest if you are not located in the United States. The Contest is subject to all applicable federal, state, and local laws and regulations. At no cost to entrant, an entrant must be a registered member of IgoUgo.com (“IgoUgo.com Site”) to participate (either through entry or voting) in the Contest. By entering and/or voting, each entrant agrees to these Official Rules, the Terms and Conditions of the IgoUgo.com Site as set forth at www.igougo.com/terms/, and the decisions of the Sponsor, which are final and binding in all respects. Void in Rhode Island, outside of the 48 contiguous United States and the District of Columbia, and where prohibited.
2. ENTRY: To enter the Contest and compete for a prize, an entrant must follow the instructions presented and may upload up to ten (10) of his/her favorite travel-related photographs per qualifying day to the IgoUgo.com Site between 12:01 am ET on May 15, 2007 and 11:59 pm ET on May 31, 2007 (“Photo Upload Period”). Each travel-related photograph submitted by an entrant is subject to all provisions of the IgoUgo.com Site’s Terms and Conditions including, but not limited to, terms and conditions related to the use of submitted photographs and other content. For a copy of the IgoUgo.com Site’s Terms and Conditions, please visit IgoUgo.com Site at www.igougo.com/terms/. Only those travel-related photographs that are deemed to be “Approved Photographs” are eligible for the Contest. Sponsor, in its sole discretion, shall determine whether a photograph is an “Approved Photograph”. No more than ten (10) Approved Photographs may be submitted by an entrant per qualifying day of the Photo Upload Period. If an entrant submits more than ten (10) Approved Photographs on any qualifying day, the excess Approved Photographs for that qualifying day will be disqualified and not eligible for the Contest. The term “qualifying day” is defined as a 24-hour period beginning at 12:01 AM ET.
3. VOTING: To vote in the Contest, visit the IgoUgo.com Site between 12:01 am ET on June 1, 2007 and 11:59 pm ET on June 15, 2007 (“Voting Period”) and vote for the Approved Photographs as presented on the IgoUgo.com Site. Only IgoUgo.com Site members ages twenty-one (21) or older who are legal residents of the 48 contiguous United States or the District of Columbia are permitted to vote in the Contest. A person may submit up to ten (10) votes for a given Approved Photograph per qualifying day during the Voting Period. All votes (and entries) generated by a script, macro or other automated/repetitive electronic means (except as permitted in these Official Rules) will be disqualified and ineligible for the Contest.
4. VOTING RESULTS/SELECTION OF WINNERS: The entrant’s objective in the Contest is to obtain the most votes during the Voting Period for one of his/her Approved Photographs submitted during the Photo Upload Period. The entrant with the highest number of votes during the Voting Period in accordance with these Official Rules will be deemed the Grand Prize Winner. The entrant with the second highest number of votes will be deemed the Second Prize Winner. The entrants with the third through seventh highest number of votes will each be deemed a Third Prize Winner. In case of a tie among entrants for a particular prize, the tied entrant with the most unique photograph (as determined in the sole discretion of Sponsor) among such tied entrants will be deemed the winner. Sponsor’s determination of the winners shall be definitive and final.
5. PRIZE DETAILS: ONE (1) GRAND PRIZE WINNER. The Grand Prize Winner will receive a 6-day/5-night trip to Mexico which includesRoundtrip coach-class air transportation for Grand Prize Winner and a guest from a major metropolitan airport near winner’s permanent residence at the time of entry to any one of the following Mexico destinations: Cancun, Los Cabos, Puerto Vallorta or Cozemel on an airline designated by Sponsor, and five (5) nights’ double-occupancy hotel accommodations at a 4-star Mexico hotel to be designated by Sponsor. Choice of destination is subject to availability at time of booking (advanced booking of 3 to 4 weeks recommended). Grand Prize does not include ground transfers, airport transfers, taxes, gratuities, travel insurance, meals, alcoholic beverages, souvenirs, or any other incidental expense not specified. GRAND PRIZE RESTRICTIONS: All travel plans for winner and any guest must be made at one time through Travelocity.com, within ninety (90) days of accepting the Grand Prize. Travel dates are subject to availability and holiday/blackout dates (including June 29-30, 2007, July 7-8, 2007, September 3, 2007, November 16-17, 20-21, 24-26, 2007 and December 21-24, 26-30, 2007), conventions and special event periods, and must be completed by December 30, 2007. All travel requests will be fulfilled based on availability. Guest must be 21 or older. If winner is unable to travel by date indicated, prize will be forfeited, and an alternate winner may be selected. If trip includes international travel and customs and immigration require certain documents to travel to foreign country, it is the winner’s sole responsibility for winner and any guest to travel with the required documents. No refunds will be made if improper documentation or other failure to meet participating travel supplier requirements (or other requirements) results in denied boarding or entry, and prize will be forfeited. Reservations are non-refundable, non-transferable, and non-changeable once issued, and may not be used in conjunction with any other competition or offer. No refunds or credit changes are allowed. If tickets are lost, they will not be replaced. Credit for previous purchases is not permitted. All tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. In addition, winner and guest are responsible for any federal, state, and local tax consequences and for compliance with all governmental reporting and payment requirements. A 1099 form identifying the winner as the recipient of income for the fair market value of the Contest will be filed with the Internal Revenue Service in accordance with applicable law, and the appropriate tax form will be sent to a winner, as applicable. ONE (1) SECOND PRIZE WINNER. The Second Prize Winner will receive a $250 gift certificate to GiftCerticates.com. To redeem your $250 gift certificate (“Gift Certificate”), go to www.giftcertificates.com. Gift Certificate is subject to the Giftcertificates.com Terms and Conditions as imposed by giftcertificates.com. Sponsor is not responsible for any lost, stolen or damaged Gift Certificate. No refund or credit will be made for any unused amounts. Sponsor does not assume any responsibility or liability for the actions, product or contents of giftcertiicate.com or any participating merchant through www.giftcerticates.com. GIFT CERTIFICATE WILL BE PROVIDED “AS IS”. SPONSOR MAKES NO WARRANTIES, EXPRESS OR IMPLIED WITH RESPECT TO THE GIFT CERTIFICATE, AND EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY.
FIVE (5) THIRD PRIZE WINNERS. Each of the five (5) Third Prize Winners will receive a US$50 gift certificate to lastminute.com. The $50 gift certificate (“Promo Code”) may only be used towards the purchase of any products or services offered through www.lastminute.com. The Promo Code for US$50 is valid upon issuance and expires on September 30, 2007. All travel associated with the Promo Code must be completed by September 30, 2007. No extensions will be permitted. Your use of the Promo Code on the lastminute.com Web site (‘Site”) is subject to its User Agreement and Privacy Policy. Promo Code is not redeemable for any other product or service except as provided herein. To redeem the Promo Code, type the Promo Code into the Promotional Code field on the billing page during check-out, and $50.00 USD will be automatically deducted from the final price of your qualifying purchase. Promo Code may not be redeemed for cash or exchanged for cash. Promo Code is not combinable with any promotions. Any unused amount will be forfeited. If lost, stolen, damaged or expired prior to use, the Promo Code will not be replaced. SPONSOR MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO PROMO CODES, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A PROMO CODE IS NOT FUNCTIONAL, YOUR SOLE REMEDY, AND THE SOLE LIABILITY OF SPONSOR SHALL BE THE REPLACEMENT OF THE NON-FUNCTIONING PROMO CODE.
The Approximate Retail Value (“ARV”) of the Grand Prize is $3,000.00. The ARV of the Second Prize is $250.00. The ARV of each Third Prize is $50.00. Total ARV of all prizes is $3,500. Actual value of Grand Prize may vary based on airfare fluctuations and distance between departure location and destination. All prizes properly claimed will be awarded. Prizes cannot be transferred, substituted or redeemed for cash, or used in conjunction with any other competition or offer. Sponsor reserves the right, in its sole discretion, to substitute and or modify a prize with a prize of equal or greater retail value if a prize is unavailable for any reason. Only one (1) prize is permitted per person and per family or household. Each potential winner may be required to provide his/her US Social Security Number for tax purposes as well as a valid government issued photo identification card.
6. WINNER NOTIFICATION: The winners will be determined by Sponsor in accordance with these Official Rules and notified on or about June 18, 2007. All decisions in all matters relating to the Contest made by Sponsor are final. Each winner will be notified by e-mail and/or telephone. If Sponsor, using commercially reasonable efforts, is unable to contact a potential winner within five (5) business days from the first contact attempt, or if a potential winner has not, or does not comply with these Official Rules, then such person shall be disqualified and an alternate winner may be selected in accordance with these Official Rules as determined in Sponsor’s sole discretion. Sponsor is not obligated to leave voice mail, answering machine or other message.
7. GENERAL CONDITIONS: To claim the prize, the winner must complete, execute and return an Affidavit of Eligibility, and a Liability and Publicity Release for himself/herself as well as his/her guest (where legally permissible) within seven (7) days of notification of status as prize winner. Failure to return documents timely, or return of any prize notification as non-deliverable, may result in the winner’s disqualification and an alternate winner may be selected. By accepting a prize, where permitted by law, each winner agrees and acknowledges (which will be confirmed in writing upon request of Sponsor) that Sponsor and its parent companies, subsidiaries, affiliates, divisions, and related companies may, without limitation or further compensation, use his/her name, voice biographical information, likeness, picture, city name, and audio and/or video recording of him/her in any and all media now known or hereinafter devised, throughout the universe and in perpetuity, for any purpose including any advertising and promotional purposes. FURTHER, BY ACCEPTING A PRIZE, EACH WINNER AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, ITS LICENSEES, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY AND ALL LIABILITY FOR ANY INJURIES, LOSS OR DAMAGE OF ANY KIND TO PERSON, INCLUDING DEATH AND PROPERTY DAMAGE, ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, USE OR MISUSE OF A PRIZE, PARTICIPATION IN ANY RELATED ACTIVITY, OR PARTICIPATION IN THIS CONTEST. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTAIL DAMAGES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO ENTRANT. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry and/or voting processes or the operation of the Contest or the IgoUgo Site; to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. In the event of a dispute as to the identity of an entrant, the entrant will be deemed to be the individual associated with the IgoUgo.com membership for the related Approved Photograph.
8. LIMITATIONS OF LIABILITY: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by IgoUgo.com Site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest and assumes no responsibility for any error, omission, interruption, deletion, effect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the IgoUgo.com Site. Sponsor is not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Contest or downloading materials from or use of the IgoUgo.com Site. If, for any reason, the Contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes Sponsor which, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Internet portion of this Contest and, if applicable, select the winner from eligible entries received prior to and/or after the action taken. In the event that more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, human or other error or problem, Sponsor shall select the actual winners as determined in accordance with these Official Rules or in any other manner deemed fair and appropriate by Sponsor in its sole discretion. No more than the number of prizes stated in these Official Rule will be awarded. IN NO EVENT WILL SPONSOR, ITS LICENSEES, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPERESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND ARISING OUT OF THIS CONTEST, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, WHETHER ARISING OUT OF TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL OR EQUITABLE THEORY. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED “AS IS” WITHOUT WARRANTY, EITHER EXPRESS OR IMPLIED, OF ANY NATURE IN RESPECT OF THE PRIZE, WHETHER IN RESPECT TO FITNESS FOR PURPOSE, SATISFACTORY QUALITY, DESCRIPTION OR NATURE OF THE PRIZE OR OTHERWISE. EACH ENTRANT ACKNOWLEDGES THAT, EXCEPT AS SET FORTH HEREIN, THE SPONSOR HAS NOT MADE AND DISCLAIMS ALL LIABILITY FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATED TO ANY PRIZE. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO ENTRANT. You may also review the Official Rules at http://www.igougo.com/photo_contest/rules.aspx or send a written request in a self-addressed stamped envelope (Vermont residents need not affix return postage) to Sponsor at the address listed in Paragraph 10.
