OFFICIAL SWEEPSTAKES ENTRY RULES (“OFFICIAL RULES”): NO PURCHASE NECESSARY. The “IGOUGO’S PHOTO FEUD PARTICIPATION SWEEPSTAKES” (the “Sweepstakes”) is sponsored by IgoUgo.com, a division of Travelocity.com LP (“Sponsor”). Void in Rhode Island, outside the 48 contiguous United States and the District of Columbia, and where prohibited.
1. HOW TO ENTER:
All entries must be received between 12:01 a.m. Eastern Time on May 15, 2007 and 11:59 p.m. Eastern Time on June 15, 2007 (the “Sweepstakes Period”). Here is how to enter:
To automatically be entered for a chance to win the Grand Prize in the Sweepstakes, visit the IgoUgo.com Web site (the “Site”) at www.igougo.com and during the Sweepstakes Period, either (a) submit a photo in the IgoUgo’s Photo Feud Contest (“Photo Contest”); or (b) vote for your favorite travel-related photograph submitted in the Photo Contest (votes must be entered between June 1, 2007 and June 15, 2007 to be eligible for this Sweepstakes). For each eligible photo that you submit in the Photo Contest (up to ten (10) photos per qualifying day (which is defined as the 24-hour period beginning at 12:01 am ET during the Sweepstakes Period)) in accordance with the Official Rules of the Photo Contest, you will receive an entry in the Sweepstakes. For each eligible vote that you submit in the Photo Contest in accordance with the Official Rules of the Photo Contest, you will receive an entry in the Sweepstakes. OR, to enter for free and without entering or voting in the Photo Contest, visit the Site at www.igougo.com/photo_contest/prize_participate.aspx and complete the Official On-line Entry Form during the Sweepstakes Period by providing the following information: first and last name, zip code, e-mail address and phone number. All such entries must be received during the Sweepstakes Period. No entry fee, purchase or proof of payment is necessary to enter the Sweepstakes.
No mechanically reproduced entries will be accepted. For purposes of these Official Rules, “receipt” of an electronic entry occurs when Sponsor’s servers record the entry information upon clicking the “submit” (or similar) button. In the event of a dispute as to the identity of an entrant, the entrant will be deemed to be the individual who is the registered holder of the e-mail account. All Sweepstakes entries generated by a script, macro or other automated/repetitive electronic means (except as permitted in these Official Rules) will be disqualified and ineligible for the Sweepstakes. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. Sponsor is not responsible for incorrect or inaccurate entry of information by entrants; lost entries or transmissions; interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions of the computer hardware, software, or any combination thereof; or problems associated with any virus or any other damage caused to entrants' systems. Incomplete entries will be voided. All entries become the property of Sponsor and will not be returned.
2. ELIGIBILITY:
The Sweepstakes is open to any individual who is:
- A legal resident of the 48 contiguous United States (except Rhode Island) or the District of Columbia;
- Twenty-one (21) years of age or older at the time of entry and has Internet access and an email account prior to start of Sweepstakes Period;
- Registered member of IgoUgo.com.;
Sweepstakes is not open to employees, officers, directors, representatives and agents of the Sponsor or any of its parent companies, affiliates, subsidiaries, divisions or advertising/promotion agencies nor is the Sweepstakes open to persons who are an immediate family member or a member of the same household (whether related or not) to such employees, officers, directors, representatives and agents.
The Sweepstakes is intended for viewing in the United States only and shall only be construed and evaluated according to United States law. You are not authorized to participate in the Sweepstakes if you are not located in the United States. At no cost to entrant, an entrant must be a registered member of IgoUgo.com (“IgoUgo.com Site”) to participate in the Sweepstakes. By entering, each entrant agrees to these Official Rules, the Terms and Conditions of the IgoUgo.com Site as set forth at www.igougo.com/terms/, and the decisions of the Sponsor, which are final and binding in all respects.
3. PRIZE DETAILS:
Participation Grand Prize Winner will receive:
- Roundtrip coach-class air transportation for Grand Prize Winner and a guest from a major metropolitan airport near winner’s permanent residence at the time of entry to London on an airline designated by Sponsor. Transportation to and from airport not included.
- Five (5) nights’ double-occupancy hotel accommodations in London at a hotel designated by Sponsor.
The Approximate Retail Value ("ARV") of the Grand Prize is $3,000.00. Guest of Grand Prize Winner must be 21 or older. Actual value of the prize may vary based on airfare fluctuations and distance between departure location and destination. All prizes properly claimed will be awarded. Prize cannot be transferred, substituted or redeemed for cash, or used in conjunction with any other competition or offer. Sponsor reserves the right, in its sole discretion, to substitute and or modify the prize with a prize of equal or greater retail value if a prize is unavailable for any reason.
4. PRIZE RESTRICTIONS:
All travel plans for winner and guest must be made at one time through Travelocity.com, within ninety (90) days of accepting the prize. Travel dates are subject to availability and holiday/blackout dates, conventions and special event periods, must include a Saturday-night stay, and must be completed by December 31, 2007. If winner is unable to travel by date indicated, prize will be forfeited, and an alternate winner may be selected. Prize may not be transferred or assigned except by Sponsor. If trip includes international travel, customs and immigration require certain documents to travel to foreign country, it is the winner’s sole responsibility for winner and his/her guest to travel with the required documents. No refunds will be made if improper documentation results in denied boarding or entry, and prizes will be forfeited. Winner will be solely responsible for all other expenses not specifically set forth herein that are incurred by winner or his/her guest, including, without limitation, meals, gratuities, souvenirs, travel insurance, taxis, rental car and rental car insurance, ground transfers, mini bar selections, room-service, upgrades, mileages redemption, alcoholic beverages and any other incidentals.
Unless otherwise designated, all air travel will be provided by an airline designated by Travelocity.com. Prizes, reservations, and airline tickets are non-refundable, non-transferable, non-changeable once issued, and may not be used in conjunction with any other competition or offer. No refunds or credit changes are allowed. If tickets are lost, tickets will not be replaced. Credit for previous purchases is not permitted. All tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. In addition, winner and his/her guest are responsible for any federal, state, and local tax consequences and for compliance with all governmental reporting and payment requirements.
5. WINNER SELECTION:
Grand Prize Winner will be selected in a random drawing from all eligible entries received. Drawing will be held by Sponsor, on or about June 18, 2007. All decisions in all matters relating to this Sweepstakes made by Sponsor are final. Odds of winning depend on the total number of valid entries received. Winner will be notified by e-mail and/or telephone promptly following drawing.
6. GENERAL RULES & CONDITIONS:
By participating in this Sweepstakes, each entrant agree to be bound by these Official Rules. Grand Prize Winner will be required to sign and complete an Affidavit of Eligibility/Liability Release, and where permitted by law, a Publicity Release (collectively the “Release Forms”). The Release Forms must be completed, signed and notarized and returned within seven (7) days of receipt of attempted delivery to receive the specified prize, otherwise the specified prize may be forfeited and awarded to an alternate winner. Guest of Grand Prize Winner must complete, sign and return a Travel Companion Liability Release, and where permitted by law, a Publicity Release (collectively, the “Travel Companion Release Forms”) prior to issuance of travel documents. The Travel Companion Release Forms must be notarized. Winner will also be required to provide their social security number to Sponsor or complete an IRS W-9 Form prior to issuance of travel documents. Failure to do so winner will be disqualified and the specified prize may be forfeited and awarded to an alternate winner. Sponsor will not use winner’s social security number for any other purpose but to comply with IRS reporting requirements and will not disclose to any third party other than the IRS without winner’s prior written consent. Each entrant acknowledges that any information provided by entrant may be disclosed to Sponsor, and that Sponsor may send marketing communications to entrants in accordance with each entrant’s “opt-in” selection. By accepting a prize, where permitted by law, winner agrees and acknowledges (which will be confirmed in writing upon request of Sponsor) that Sponsor and its parent companies, subsidiaries, affiliates, divisions, and related companies may, without limitation or further compensation, use his/her name, voice biographical information, likeness, picture, city name, and audio and/or video recording of him/her in any and all media now known or hereinafter devised, throughout the universe and in perpetuity, for any purpose including any advertising and promotional purposes. These Official Rules and all matters related to the Sweepstakes will be governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes arising under, or related to, the Sweepstakes must be brought in the federal or state courts located in Tarrant County, Texas.
7. FORFEITURE OF PRIZE/SELECTION OF ALTERNATE WINNER:
Forfeiture of prize and the selection of an alternate (provided sufficient eligible entries are received) winner may result from any of the following: (1) a potential winner does not respond to a notification email or phone call (with all requested information) within the required time; (2) an email notification is returned as undeliverable after three (3) attempts; (3) the failure of a potential winner to complete, sign, notarize and return required Release Forms/Travel Companion Release Forms (and any other documents, if requested) within the required time; (4) any prize notification/documentation/prize returned as undeliverable for any reason; (5) a potential winner is ineligible or cannot be notified or contacted; (6) a potential winner's inability to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the email address associated with the winning entry (if requested); (7) failure to respond to any other required time periods; (8) any other non-compliance with the Official Rules. Proof of response by a potential winner does not constitute proof of receipt by Sponsor. In all instances in which Sponsor notifies, or seeks to deliver a prize or otherwise attempts to contact an alternate winner, if such alternate winner is unavailable or disqualified or if the prize is returned as undeliverable within the time frames otherwise allotted for the initially selected winner, then Sponsor may use its judgment to determine disposition of the prize (randomly select another entrant, donate the prize or forfeit and not award the prize) in Sponsor's sole discretion.
8. LIMITATION OF LIABILITY:
SPONSOR, AND ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, ADVERTISING AND PROMOTION AGENCIES INVOLVED IN THE SWEEPSTAKES SHALL HAVE NO LIABILITY AND SHALL BE HELD HARMLESS BY ENTRANT FOR ANY DAMAGE, LOSS OR LIABILITY TO PERSON OR PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, BY REASON OF ENTERING THE SWEEPSTAKES, THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, OR WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO AND FROM ANY PRIZE-RELATED ACTIVITY. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred not to exceed $3,000.00, including costs associated with entering this Sweepstakes. In the event that more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, human or other error or problem, a random drawing will take place from among all eligible prize claims for the prize at issue to award the proper number of prizes as set forth in these Official Rules. Inclusion in such drawing shall be entrant’s sole and exclusive remedy under such circumstances. No more than the number of prizes stated in these Official Rule will be awarded.
9. TAMPERING:
Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend this Sweepstakes for any reason, including if: (a) viruses, bugs, unauthorized human intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes; or (b) earthquake, flood, fire, storm or other natural disaster, act of god, labor controversy or threat thereof, civil disturbance or commotion, terrorism, disruption of the public markets, war or armed conflict (whether or not officially declared). In such event, the prize winner will be selected by Sponsor by a random drawing from all eligible entries received up to (and/or after) the time of such cancellation, termination, modification or suspension, or in such other fashion as shall be considered equitable in the sole discretion of the Sponsor. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. Sponsor and its promotion and advertising agencies are not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the Sweepstakes.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT OR ANY OTHER INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

You may also review the Official Rules at http://www.igougo.com/photo_contest/rules.aspx or send a written request in a self-addressed stamped envelope (Vermont residents need not affix return postage) to Sponsor at the address listed in Paragraph 11.
